MERRITT, Circuit Judge.
In this suit by white police officers challenging the Detroit Police Department’s affirmative action plan, the officers appeal from the District Court’s grant of summary judgment in favor of the City which was based upon principles of collateral estoppel and stare decisis. Although we agree with the District Court that relitigation of the issue of the City’s general past discrimination should be barred by principles of collateral estoppel, we disagree with the lower court’s determination that judicial review of the reasonableness of the remedy should also be barred.…
