OPINION

HARKINS, Senior Judge.

This case is before the court on cross-motions for summary judgment. Jurisdiction is under the Tucker Act, based on express contracts with the United States. 28 U.S.C. § 1491(a)(1).

Plaintiff, Tri-State Motor Transit Company (TSMT), is a motor common carrier that, during the relevant period 1989-94, was subject to regulation by the Interstate Commerce Commission (ICC).1 TSMT has been *486a common carrier for more than 20 years.
