This appeal comes to this court on questions of law from a judgment entered for the plaintiff on the verdict of a jury in the Court of Common Pleas of Lucas County. The plaintiff, during the time encompassed in his petition, was a Judge of the Municipal Court of the city of Toledo, Ohio, and was then a candidate for election to succeed himself, he having been appointed to fill an un-expired term.
