This was an action of replevin by the appellants against the appellees. George Hazzard, one of the appellees, bought the goods in controversy from the appellants upon credit, by fraud and false pretences. Before the credit expired, he gave the appellants for the debt the following note:
*59“$1388.23. New York, August 10th, 1878.
“Twenty days after date we promise to pay to the order of H. B. Claflin & Co., value received, thirteen hundred and eighty-three &s dollars, at Third National Bank in New York. [Signed] George W. Hazzard & Co.,
“Due Sept. 2, ’78. Auburn, Ind.”
