Motion by the defendants, Seth L. Keeney and others, for a new trial on a case containing exceptions, ordered to be heard at the Appellate Division in the first instance, upon the verdict of a jury in favor of the plaintiff, rendered after a trial at a Trial Term of the Supreme Court held in and for the county of Kings on the 2d day of June, 1896.

The defendants were, in the month of June, 1892, directors of the Commercial Bank, a banking corporation located in the city of Brooklyn, having a capital of $108,000. Said bank was, by a judgment of this court, entered in the clerk’s office of Kings county on November 4, 1893, dissolved, and the plaintiff was by said judgment appointed the permanent receiver thereof.
