This is an action brought by the plaintiff in error to recover the value of a large quantity of lumber destroyed by fire, which was alleged to have been set out by the engine of defendant in error. The defendant in error operates a lumber manufacturing - plant. It owns a considerable amount of timber in the county of Lunenburg, and in con*411nection with its enterprise is engaged in hauling logs from the woods to its sawmill.
