Ware has appealed from, an order of the judge of tbe district court declining him a temporary writ of injunction which was sought to restrain the sale of property belonging to him under an execution which had been executed on a judgment of tbe Court of Civil Appeals, reported in 233 S. W. 355, which judgment was affirmed by the Supreme Court, as reported in 242 S. W. 1022, the style of the case in those courts being Ware v. Jones.
