There is a preliminary question to be disposed of, although submitted in the reply brief. Defendant Dewey L. Carpenter moved the court to dismiss the appeal of May H. Carpenter, cross-appellant, on the grounds that cross-appellant has enforced her rights under the judgment and decree, and it would be inconsistent for her now to challenge the same, and that this court has no jurisdiction to hear an appeal from a judgment that has been so consented to and confirmed.
