{¶ 1} Plaintiff-appellant, Larry Keel, appeals the January 22, 2009 judgment of the Lucas County Court of Common Pleas, which granted defendant-appellee Toledo Harley-Davidson/Buell’s motion for summary judgment. For the reasons set forth herein, we affirm in part and reverse in part.

{¶2} The facts of this case are as follows. On March 6, 2008, appellant purchased a used 2007 Harley-Davidson motorcycle from appellee for $23,761.54. Appellant had possession of the motorcycle for 19 days and had driven it 91 miles when he returned to appellee’s dealership complaining that…
