This is an appeal by defendant from a judgment permanently enjoining him from proceeding with a pending divorce action in Indiana wherein he is the plaintiff.
The parties were married in Indiana in July, 1952. Prior to their marriage the wife resided in Indiana, the husband in New York. After their honeymoon they took up residence in New York. Very shortly thereafter they separated, the wife returning with all her baggage to her mother in Indiana by October 4 and the husband remaining in New York.
