Appeal from a judgment of the superior court for Pierce county, Clifford, J., entered October 16, 1908, upon findings in favor of the plaintiffs, after a trial before the court without a jury, in an action on contract.

The respondents brought this action to recover for professional services rendered the appellant. In their complaint they averred the corporate capacity of the appellant, their own copartnership, and continued as follows :

“(3) That on or about the 6th day of February, 1908, plaintiffs and defendant entered into a certain contract for the performance by the plaintiffs of professional work and services in the designing and construction of a coal washing and storage plaht for the defendant at its mine in the said town of Wilkeson, Washington, under and by virtue of which contract plaintiffs were…
