The substituted complaint alleges, in substance, these facts: Chester S. Selleck was treasurer of the plaintiff and also administrator of the estate of Henry Green, late of Norwalk, and that on the date of his appointment as such administrator, the defendant the National Surety Company executed a bond in the penal sum of $70,000, in which bond Selleck was principal and the Surety Company surety, and that this was duly filed in the Court of Probate for the district of Norwalk; that the condition of the bond was that if Selleck “shall faithfully discharge the duties of his said trust [as said…
