This action was commenced by the plaintiff, a corporation duly incorporated under the laws of Ohio, 'against the defendant, John Giacin, doing an ice cream business under the pseudo corporate *550name of “The French Ice Cream Co.” in the city of Cincinnati and vicinity, to enjoin forever the defendant from in any way using the name “French” in connection with his, the defendant’s, ice cream business, and for damages in the sum of $10,000, and for equitable relief.
