The defendant Detroit, Grand Haven & Milwaukee Railway Company procured by ordinance from the common council of the city of Grand Rapids the right to lay and maintain a railroad track in Bond avenue opposite and in front of the plaintiffs’ premises, with the right and privilege of operating trains on said track between the hours of 11 o’clock p. m. and 5 o’clock a. m.
