This case was tried to the court. The trial resulted in a judgment in favor of the plaintiffs. The defendant appeals. 'He brings up only the judgment roll without a bill. He contends the complaint does not state a cause of action and that the court failed to find on a material and necessary issue.

In the complaint is it alleged that on August 25,1928, the plaintiffs and the defendant entered into a written agreement by the terms of which the plaintiffs sold to the defendant certain described real estate for a consideration of $1,400, of which $100 was to be performed in labor by the defendant…
