This action was commenced in the district court of Muskogee county by Thomas Hutton and Lettie Hutton, defendants in error, plaintiffs below, against William Barker, plaintiff in error, defendant below, to cancel a contract for deed and recover possession of the northerly 331-3 feet of the southerly 662-3 feet-of lot 14, in block 116, in the city of Muskogee.

The parties will be referred to in rhis opinion as plaintiffs and defendant as they appeared in the lower court.
