Plaintiff Aileene S. Minton, Joan S. Lowe, Martha S. Oxford, and Kathleen S. Miller, a North Carolina Partnership, instituted this action against defendant Lowe’s Food Stores, Inc. for summary ejectment and damages for failure to pay rent, in Caldwell County Superior Court on 4 March 1992. A hearing on plaintiff’s Motion for Summary Judgment was heard by Judge Claude S. Sitton, Chief Resident Superior Court Judge, at the 24 August 1992 civil session of Caldwell County Superior Court.
