This is an appeal by the defendant Birdseye Development Company (Birdseye) from the judgment of the trial court dismissing its appeal from the decision of the employment security board of review.

David Miller made a claim for unemployment compensation benefits after his employment by Standard Oil Company was terminated. The administrator found that the claim was valid and awarded benefits, charging the account of Birdseye, a previous employer.
