On February 7, 1899, plaintiff brought this action to quiet title to a certain ten-acre tract of land. On March 28, 1899, the defendant filed a cross-complaint asking for the specific performance of a certain contract relating thereto, a copy of which is set forth in the cross-complaint. Said contract is dated January 15, 1892, and was made between the plaintiff and one Griffith, and provides that upon Griffith performing certain conditions set forth therein, in regard to setting out trees thereon and caring for the same, he should, at the end of three years, become entitled to a…
