Plaintiff in error sued the defendants in error before' a justice of the peace of Grant county. Service, however, was not obtained on Decker. The other defendants in error filed demurrer, but made no appearance before the justice of the peace. Judgment was rendered for plaintiff in error and defendants in error Harper, Dow and Johnson appealed to the county court. The case was tried to the court and jury, and, upon motion of defendants in error, the court instructed a verdict in their favor, from which the plaintiff in error appealed, assigning as error:(1) “In overruling…
