Plaintiff Wm. Aupperle & Sons, Inc., a subcontractor for a construction project, appeals from the dismissal of a citation proceeding which had been filed against the project architect Daniel Comm & Associates, Inc. This litigation commenced in 1971 when plaintiff filed a complaint to foreclose a mechanics’ lien for labor and materials furnished to construct an apartment building complex in Peoria.
