The case comes before the court on the plaintiff’s motion for summary judgment. The United States brings this action on behalf of the Commodity Credit Corporation to recover certain payments made to a dairy farmer, Paul Goode, pursuant to the Milk Diversion Program created by the Dairy and Tobacco Adjustment Act of 1983, 7 U.S.C. § 1446(d).
