This case comes before the Court on an order by the United States Court of Appeals for the District of Columbia Circuit holding in abeyance Plaintiffs appeal and directing this Court to consider Plaintiffs filing captioned “Appeal of Order Dismissing Case for Failure to Serve” as a motion to reconsider the Court’s June 24, 2009 Order dismissing this case without prejudice for failure to serve.
