RULING ON DEFENDANT’S MOTIONS TO DISMISS

This case is before the Court on two motions to dismiss by Defendant Castleton State College (“Castleton”). Plaintiff Joseph J. Brown (“Brown”) filed his original Complaint on January 5, 2009, and in response Castleton filed a Motion to Dismiss (Paper 4). Brown subsequently filed an Amended Complaint, and Castleton filed a new Motion to Dismiss Amended Complaint (Paper 9).
