MEMORANDUM AND ORDER
NEALON, Chief Judge.
Plaintiff filed this complaint on August 5, 1985, invoking this court’s jurisdiction under 28 U.S.C. §§ 1331 and 1343. Relief is sought pursuant to 42 U.S.C. § 1983 and the Fourteenth Amendment to the United States Constitution. Defendants, City of Hazleton (“City”) and Michael Conway (“Conway”), filed a Motion to Dismiss or, in the Alternative, for Summary Judgment, a brief in support thereof and supporting documentation on April 29, 1986.
