— This is an action for the specific performance of a contract for the conveyance of certain real estate in Shelby County. The complaint is in two paragraphs. The defendant answered each paragraph of the complaint. The cause was submitted to a jury and on November 10, 1943, the jury returned its verdict in favor of appellee on his second paragraph of complaint.
