Defendant has taken an appeal to this court from a judgment of conviction entered pursuant to a jury verdict of murder in the first degree with recommendation of life imprisonment. 1947 Const., Art. VI, § V, par. 1(c); R. R. 1:2-1 (c).

Evidence was presented by the State that in the early hours of the rainy morning of March 14, 1956, some time about 4:00 A. m., a fire broke out in St. Mary’s Cathedral and Rectory located on North Warren and Bank Streets in the City of Trenton.
