The parties will be referred to as they appeared in the trial court. Plaintiff filed this action below seeking to compel defendant county treasurer by mandamus to place certain delinquent paving assessments upon the tax rolls of Tulsa county for the year 1943, or the next available year for collection, in the manner provided by law. The defendant in his response pleaded in substance that the certificates of paving assessments were barred by the statute of limitations, that the claim was stale, and plaintiff was guilty of laches.
