OPINION
MILLER, Judge.
This case is before the court after transfer on November 1, 2001; briefing on defendant’s pending motion for partial dismissal and for partial summary judgment was completed on April 29, 1999. The issues for decision are 1) whether certain of plaintiffs claims were timely filed under the Contract Disputes Act of 1978, 41 U.S.C. § 609(a)(3) (1994) (the “CDA”), which requires that “[a]ny action ... shall be filed within twelve months from the date of the receipt by the contractor of the decision of the contracting officer concerning the claim;” and 2) whether certain of…
