SMITH, Circuit Judge.
The appellees were the plaintiffs and the appellant was the defendant in the District Court, and they will be styled here as in the court below. For some time prior to August, *6211898, all the parties, to this suit were residents of Des Moines, Iowa. Dr. Cooper was a practicing physician and surgeon and a considerable property owner there. He was a stockholder and director of the German Savings Bank of that city, and owned about 450 shares out of a total of 1,000 of the stock of the Fidelity Insurance Company of that city.
