This cause is here to review a summary judgment dismissing the second claim of the complaint in the dis trict court of the City and County of Denver. The parties here appear as in the trial court, plaintiff and defendants.
By the pleadings, Ida M. Johnson, owning 280 acres of land in Weld county, on November 13, 1928 executed her oil lease thereon, which lease now is assigned to defendant Pepper.
