The information in this case charges that on April 29, 1923, C. S. Grubbs did have in his possession about two gallons of whisky, with the unlawful intent to sell the same. On the trial the jury returned a verdict, finding him guilty, and fixing his punishment at a fine of $100 and confinement for 30 days in the county jail. From the judgment he appeals.
