HOWARD, Chief Judge.
This cause is before the Court on Defendants’ motions for Summary Judgment. [Docs. 36, 43, 46]. Brian Christopher Fa-cemire was shot while intervening in an argument in the parking lot at the Mobile Festival Center following the Sky Show ’90 fireworks that took place there on July 4th, 1990.
