MEMORANDUM & ORDER
DEVITT, Chief Judge.
This suit is brought by trustees of pension funds seeking to recover contributions allegedly owed by an employer for the time period of 1971-1979. Plaintiffs allege jurisdiction under section 301 of the Labor Management Relations Act, 29 U.S.C. § 185, and under the Employees Retirement Income Security Act (ERISA), 29 U.S.C. § 1001 et seq. 1
