Deborah Katz Pueschel was employed by the Federal Aviation Administration (“FAA”) as an air traffic controller between 1974 and 1981, when the FAA fired her for participating in an illegal strike. She appealed her removal to the Merit Systems Protection Board (“MSPB”), seeking reinstatement. After finding that she had not participated in the strike, the MSPB ordered her reinstated with back pay. Katz v. Dep’t of Transp., 17 M.S.P.R. 303 (1983).
