Plaintiff Donald Smith brings this action against the District of Columbia, Officer Travis Eagan, and three other unknown but named officers (“John Does 1-3”) alleging a violation of his Fourth and Fourteenth Amendment rights pursuant to 42 U.S.C. § 1983. Now before the Court is defendant District of Columbia’s (the “District”) motion to dismiss pursuant to Federal Rule of Civil Procedure 12(b)(6).
