OPINION
This action in prohibition is presently before this court for final consideration of respondent's motion to dismiss, filed on November 13, 2001. As the primary basis for his motion, respondent, Judge Mitchell F. Shaker, contends that the prohibition petition does not state a viable claim for relief because he has not acted in such a manner as would deprive him of jurisdiction to proceed in the underlying case.
