The plaintiff in ferror was plaintiff and the defendant in error was defendant in the trial court, and, for convenience, they will be referred to herein as they there appeared.

On June 23, 1925, the plaintiff: was walking west on 18th street, in Oklahoma City, and wh’en she reached, a point on the sidewalk opposite and in front of the residence of the defendant, which is located at the intersection of 18th street and Walker avenu'e, she slipped on the sidewalk and fell, breaking her left arm. Water, coming from the defendant's yard, which is terraced and about six or seven feet…
