On the 6th day of February, 1899, Chris Thomsen filed his.petition in the district court for Dodge county *371against the Fremont Carriage Manufacturing Company, a corporation duly organized and existing under the laws of this state, and one John Bunt, to recover the sum of $800, and interest thereon, from the 4th day of September, 1897.
