Plaintiffs instituted this action to quiet title to certain tide lands fronting a government lot on Puget Sound, claiming title thereto by virtue of a deed from the state of Washington, dated September 18, 1928. Defendants assert title to a three-fifths interest in the lands under a patent from the United States and a chain of mesne conveyances. The patent was issued January 18, 1890, following the issuance of a receiver’s receipt dated August 10, 1888.
