BAKES, Justice.

This appeal resulted from an order granting summary judgment in favor of the Idaho Nuclear Corporation, hereinafter referred to as respondent, against William D. Straley, hereinafter referred to as appellant. Appellant had instituted this action to recover damages for personal injuries sustained while riding in one of respondent’s buses. The primary issue for disposition on appeal is whether the district court properly granted summary judgment in favor of respondent.
