This matter is before the court on the parties’ petition for approval of a class settlement pursuant to Rule 23(e), F.R. Civ.P. Plaintiffs, a class comprising the holders of bonds issued in 1896 by the predecessor of defendant Burlington Northern Railroad Company (“the Railroad”),1 brought suit in 1985 to enjoin the Railroad from substituting other collateral for certain realty (“the Resource Properties”) by which the bond mortgages are secured.
