This is an action of ejectment, brought by one tenant in common against his co-tenant, for the recovery of an undivided, share of a part of the common property. The plaintiff alleges in his complant, that on the 1st day of September, 1858, he was seized as owner in fee, and was entitled to the possession of a certain tract of land, describing it as a tract half a mile square and situate in the County of Contra Costa; and that he is still the owner and entitled to the possession thereof.
