This is an appeal from an order denying -defendants’ motion for a new trial.
Plaintiff’s action is to quiet its alleged title to certain land and to enjoin defendant Stewart from selling said land on an ■execution issued to him, as sheriff of Santa Barbara County, upon a judgment in favor of the defendant Mullenary, against •one J. Ben Burton. The suit of Mullenary v. Burton was begun January 8, 1903, and on that day an attachment therein was issued and levied on the land in dispute.
