Appellees were plaintiffs below, and sued appellant under the provisions of section 2256, Code of 1906, for damages under said section resulting from the purchase of thirty-three sacks of one hundred pounds each of the brand of fertilizer known as “12-4-4, high grade fertilizer, Eed Steer brand,” alleging that the said.fertilizer as branded and analyzed on the sacks contained certain valuable elements, and charged that said fertilizer was deficient in certain of the valuable elements, and alleged that the price agreed to be paid for the fertilizer was seventy-seven dollars and fifty-five…
