MEMORANDUM OPINION AND ORDER

CONTIE, District Judge.

Russell Roush has petitioned the Court for habeas corpus relief. His applica tion to proceed in forma pauperis has been granted. An evidentiary hearing was held on June 19, 1974. Oral arguments were heard on October 10, 1974.

In the early morning of July 17, 1971, Frank Grosse, a Stark County Deputy Sheriff working as an undercover agent in the Narcotics Unit, purchased from Charles Tawney certain substances which were represented to be LSD and hashish.
