MEMORANDUM OPINION AND ORDER

GUZMAN, District Judge.

Pending is Defendant’s, Chicago Transit Authority (“CTA”) motion to dismiss pursuant to Fed.R.Civ.P. 12(b)(6). For the reasons set forth below this motion is denied in part and granted.

BACKGROUND FACTS

At approximately 4:00 p.m. on June 10, 2000, after departing from a White Sox game at Comiskey Park, the Plaintiff, Chet Olinger, and a friend were in CTA’s Green Line 35th Tech Station, located in the City of Chicago.
