LOCAL GOVERNMENT TORT CLAIMS ACT – “TORTIOUS ACT OR OMISSION” – STATE STATUTORY CLAIMS The Local Government Tort Claims Act (“LGTCA”) caps the amount of damages that can be awarded against a local government entity in a lawsuit arising from the “tortious acts or omissions” of local government employees committed within the scope of their employment and without malice.
