This action was commenced by respondent David B. Allison to recover upon a beneficiary certificate issued by the Grand Lodge of the Brotherhood of Railroad Trainmen *492upon the life of his son, Thomas B. Allison. The more important facts are stipulated in the record, and from the record it appears that the respondent was the first beneficiary named in this certificate, which was issued to the assured in November, 1905, and that subsequently, appellant and insured having intermarried, he transferred the certificate to her, in accordance with the constitution and general rules of the Brotherhood.…
