On September 7, 1935, the plaintiff John Lembke, brought an action against John M. Fritz, doing business as the Fritz Oil Company, and Ervin Beisner for personal injuries received February 13,1934, in a collision between plaintiff’s automobile and a truck owned and driven by defendant Beisner. The petition alleges that the defendant Beisner was, at the time of the accident, an employee, servant and agent of the defendant John M.
